These Terms of Service ("Terms") govern your use of the Energee HX website and your engagement of Energee HX ("we," "us," "our") for home improvement services. By using our website, contacting us, or engaging our services, you agree to these Terms.
1. Our Services
Energee HX provides residential home improvement services including roofing inspection, repair, and replacement; energy-efficient smart thermostat installation and monitoring; and detach & reset services. All services are subject to a written estimate or service agreement, which controls in the event of any conflict with these Terms.
2. Estimates & Quotes
Assessments and quotes are provided free of charge unless otherwise stated. Quotes are estimates based on visible conditions and information available at the time; final pricing may change if hidden conditions, code requirements, or scope changes are discovered, and any change will be communicated and approved before additional work proceeds. Quotes are valid for 30 days unless otherwise stated in writing.
3. Scheduling, Access & Cancellation
You agree to provide reasonable and safe access to your property for scheduled work. If you need to cancel or reschedule, please give us at least 24 hours' notice. Project timelines are good-faith estimates and may be affected by weather, material availability, permitting, or insurance processing.
4. Payment
Payment terms are set out in your estimate or service agreement. Unless otherwise agreed, payment is due upon completion of the work. Late payments may be subject to interest and collection costs to the extent permitted by law.
5. Financing
Financing, where offered, is provided by independent third-party financing providers, not by Energee HX. All financing is subject to the provider's application, credit approval, and terms and conditions. Energee HX does not make credit decisions and is not a lender. Your financing agreement is solely between you and the financing provider.
6. Insurance Claims Assistance
Where we assist with insurance claims for roof or storm damage, we act as your contractor — documenting damage, providing estimates, and communicating scope with your insurer at your direction. Coverage decisions are made solely by your insurance company. Energee HX is not an insurance company, does not guarantee any coverage outcome, and does not act as a public adjuster. You are responsible for your deductible and any amounts not covered by insurance, as required by law. Under Texas law, it is a crime to knowingly submit a false or fraudulent insurance claim or to waive, absorb, or rebate an insurance deductible.
7. Workmanship & Warranties
We stand behind our work. Workmanship warranties, if any, are stated in your service agreement. Manufacturer warranties on equipment and materials (including thermostats and roofing materials) are provided by the manufacturer under their own terms. Warranties do not cover damage caused by misuse, neglect, unauthorized modification, acts of nature, or work performed by others.
8. Monitoring Services
Where your smart thermostat includes system monitoring, monitoring is a support feature intended to help identify potential performance issues and alert you; it is not an emergency service, is not a substitute for professional HVAC service, and does not guarantee that every issue will be detected or prevented. Repairs to HVAC equipment, where needed, should be performed by an appropriately licensed contractor. You remain responsible for maintaining your home's systems.
9. Communications
By providing your contact information, you agree that we may contact you by phone, text message, and email regarding your inquiry and services. Text messaging terms, including how to opt out, are described in our Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law, Energee HX's total liability arising out of or related to our services shall not exceed the amount you paid us for the services giving rise to the claim, and we shall not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Texas. Before filing any claim, you agree to contact us and give us a reasonable opportunity to resolve the issue. Any disputes shall be resolved in the state or federal courts located in Dallas County, Texas.
12. Website Use
Website content is provided for general information and is not a binding offer. You agree not to misuse the website, attempt to access it without authorization, or use it for unlawful purposes. All logos, trademarks, and content are the property of Energee HX and may not be used without permission.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of our website or services after changes constitutes acceptance.
